Artist Booking Contract

1. Parties to This Agreement

This Artist Booking Agreement ("Agreement") is entered into between:

Together referred to as "the Parties." The Agency acts as booking representative for the Artist named in Section 2 and enters into this Agreement on the Artist's behalf.

All payments shall be made by bank transfer (IBAN) to the account details provided by CEP Agency upon contract signing. All fees are quoted in Euros (EUR). Bank charges, international wire fees, and currency conversion costs are the sole responsibility of the Client.

3.3 Late Payment

Outstanding balances not received by the due date will incur a late payment fee of 5% per week on the outstanding amount. CEP Agency reserves the right to cancel the booking without refund of the deposit if the balance is not received within 7 days of the due date.

3.4 Additional Costs

The following costs, where applicable, will be invoiced separately and are not included in the Artist Fee unless expressly stated:

• Return flights (economy class unless otherwise agreed)
• Ground transportation to and from the venue
• Hotel accommodation (minimum 3-star, single room)
• Visa and work permit fees where required
• Backline equipment rental if not provided by the venue

4. Technical Rider

The Client is responsible for providing the following technical requirements unless otherwise agreed in writing. Failure to provide adequate technical facilities may result in the Artist declining to perform without penalty to CEP Agency or the Artist.

A full technical rider specific to the booked artist will be provided by CEP Agency upon contract signing and supersedes the above general requirements.

5. Hospitality & Travel

Unless otherwise agreed in writing, the Client shall provide or arrange the following for the Artist and any accompanying crew members specified by CEP Agency:

6.1 Client Obligations

• Provide all technical and hospitality requirements as specified in this Agreement
• Ensure all necessary permits, licences, and public liability insurance are in place for the event
• Provide adequate security and crowd management personnel
• Not approach the Artist directly for bookings, bypassing CEP Agency
• Promote the Artist accurately using approved promotional materials only
• Notify CEP Agency immediately of any changes to event details

6.2 CEP Agency Obligations

• Confirm Artist availability and secure the agreed performance date
• Provide technical rider and hospitality requirements in a timely manner
• Ensure the Artist is briefed on all event requirements
• Act as primary point of contact between Client and Artist
• Issue a signed contract within 5 business days of booking confirmation

7. Cancellation Policy

7.1 Client Cancellation

All cancellations must be submitted in writing to [email protected]. Verbal cancellations are not accepted.

7.2 Artist / Agency Cancellation

In the event of cancellation by the Artist due to illness, injury, bereavement, or circumstances genuinely beyond their control, CEP Agency will make reasonable efforts to provide a replacement artist of comparable calibre. If no suitable replacement is available, a full refund of all payments received will be issued within 14 business days.

7.3 Force Majeure

Neither party shall be liable for failure to perform due to circumstances beyond reasonable control, including natural disasters, government restrictions, pandemic measures, war, civil unrest, or venue closure. Both parties will negotiate in good faith to reschedule or reach a fair resolution.

8. Intellectual Property & Recording Rights

The Client acknowledges that the Artist retains full ownership of all intellectual property in their performance, music, and brand identity. The following restrictions apply:

• Audio or video recording of the performance requires prior written consent from CEP Agency
• Live streaming or broadcasting requires a separate written agreement and may incur additional fees
• Promotional photographs taken at the event may be used by the Client for event promotion only, with artist credit
• The Artist's name, likeness, and logo may be used for event promotion only with prior approval of materials by CEP Agency
• Any unauthorised recording, streaming, or commercial use of the performance is a material breach of this Agreement

9. Confidentiality

Both parties agree to keep strictly confidential all non-public information exchanged under this Agreement, including but not limited to: artist fees, availability schedules, personal contact details, unreleased music, and internal business information. This obligation survives termination of this Agreement for a period of three (3) years.

10. Liability & Indemnification

CEP Agency's total liability under this Agreement shall not exceed the total Artist Fee paid. CEP Agency is not liable for indirect, incidental, or consequential damages, loss of profits, or events beyond reasonable control.

The Client agrees to indemnify and hold harmless CEP Agency, the Artist, and their affiliates from any claims, liabilities, or expenses arising from the Client's event, breach of this Agreement, or any negligent or unlawful act by the Client or their staff.

11. Governing Law & Disputes

This Agreement is governed by the laws of the Netherlands. Any disputes shall first be resolved through good-faith negotiation, then mediation in Amsterdam, and finally through the competent courts of Amsterdam, the Netherlands.

12. Signatures

By signing below, both parties confirm they have read, understood, and agree to all terms of this Agreement. This Agreement becomes legally binding upon receipt of the signed document and the deposit payment.
